The purchase of travel and tourism services and products from Miri Adventures complies with the current legislation applicable to this matter, especially the Consumer Defense Code and is subject to the general terms and conditions specified below.

Miri Adventures is a tourism company and online tour operator, whose technological platform allows us to market our services to users, who, for their part, can search for information about, tours and excursions in Cozumel Island Mexico in different aspects such as, aquatic and terrestrial, as well as the organization of programs, services, and travel itineraries, individual or in groups, organization of programs and services related to education or cultural and other tourist services (the “Tourist Service(s)”), compare and book such offers in real time, and purchase them separately or together, configuring and managing their own trip, according to their personal needs.

The specifications of the services and products contracted by the Client will be provided in their description on our online page, which contains the terms and conditions of the service or product that Miri Adventures is offering.

The operations of use, processing, exchange and other activities carried out with your Personal Data will be carried out in accordance with the applicable data protection legislation, in particular the General Personal Data Protection Act, and with our Privacy Policy.

We emphasize that these activities will be carried out exclusively for legitimate purposes, explicit and previously informed in our Privacy Policy, always limited to the use of the minimum volume of data necessary to fulfill these purposes and permitted on the basis of the applicable authorizations granted.

 

1. PRICES

The prices of the products and services offered by Miri Adventures will have their validity limited to the periods mentioned in the respective promotional materials, advertisements and quotations, being subject to increases and changes derived from exchange variation, rates applied by determination of competent authorities, increase in searches, as in high seasons, long weekends, holidays, events or celebrations, among other factors.

The prices include only and exclusively the products and services expressly specified in the description of the negotiated sale contained in the conditions delivered / sent to the Client when acquiring the products and services. Unless otherwise specified in the products and services sold to the Client, prices do not include services such as: (a) Gratuities; (b) breakfast and/or meals served in the lodgings; (c) personal expenses, such as laundry, letters, telephone calls, among others; (d) overnight stays exceeding the specifically scheduled period.

The purchase of products and services shall be made by payment of the agreed amount by Credit Card or other forms of payment accepted by Miri Adventures in its online agency.

It is provided that, at the time of purchase of products and services by the client, fees related to services provided by Miri Adventures outreach agents may be included in the total price of the excursion.

Failure to timely settle any payment will result in the collection of interest and possible monetary restatement, in addition to attorney’s fees and court costs, when payment is required in court.

2. ACCOMMODATION

Scheduled check-in and check-out times at our Casa Samay lodging will be informed to the Client on the Miri Adventures website at the time of purchase.

 

It is the Client’s responsibility to verify and pay the amounts charged for extra services at the Casa Samay hostel, such as: taxes and/or additional fees to the contracted price, which are not included in the Conditions of Service and Product and which must be paid by the Client directly to the Supplier.

 

3. TRANSFER

The products and services purchased by Clients on the Miri Adventures page may include, if specified, transfers from their accommodation or ferry station only within the Island of Cozumel, through vehicles, carried out by qualified professionals.

 

4. ACTIVITIES AND TICKETS

The activities included in the client’s purchase will be carried out, and can be carried out together with other tourist groups, without priorities or special treatments.

5. OTHERS

Unless otherwise specified in these Terms and Conditions, the rules and policies of other services or products (e.g. cruises, travel insurance) will comply with the terms of the contracts of each Supplier of the products purchased by the Customer.

6. CUSTOMER RESPONSIBILITY

Without prejudice to the provisions of these General Conditions, the Client is responsible: (i) for paying the price established for the reservation and purchase made; (ii) comply with the times and procedures established in your reservation and any changes; (iii) make confirmations of reservation services in advance as necessary and within a reasonable time; (iv) comply with the guidelines received by Miri Adventures and/or its promoters; (v) comply with the indicated and recommended safety procedures for boarding aircraft and other means of transportation used in travel; (vi) care for personal items, such as money, jewelry, equipment and other materials of sentimental or monetary value; (vii) assume losses and damages arising from actions or omissions caused by your fault; (viii) preserve the areas, facilities and equipment made available to you during your excursion; and (ix) adopt procedures that contribute to integration and cordiality among the participants and between them and the population of the places to visit.

Failure to comply with any of the above provisions will give rise to the possibility of Miri Adventures terminating, in whole or in part, the contract concluded as a result of the contracted products and services, by charging a fine equivalent to 30% (thirty percent). of the value of the purchase made by the Client, and the Client may also be held responsible for damages arising from breach of contract, under the terms of current legislation.

The Client must inform Miri Adventures, through our customer service channel, when purchasing services and products, about any limitation or impediment of their family members or companions, derived from illness, disability, physical or mental reasons, or any any other cause that may hinder, harm the Client or imply special care during the development of their excursion. It is also the client’s responsibility to inform the guides and/or staff (transport, accommodation, excursions and others) and follow the rules defined by each of these activities in terms of documentation, authorization, shipping deadline and, on the part of the guides, , acceptance and approval of the documents sent; Miri Adventures will do everything possible so that the Client, even with some limitations, can enjoy the services and products purchased.

If the client fails to comply with any of the conditions below, they must contact us directly and request information on whether they will be accepted and/or the procedures and documentation required to carry out their activities, in order to perform the contracted service: Wheelchairs ; Pregnant and lactating women; Unaccompanied minors; pet animals; Guide dog; Fragile and valuable items; Sports articles.

7. LOST AND FOUND

It is the Client’s responsibility to take care of their personal items, such as money, jewelry, equipment and other materials with sentimental or monetary values. Miri Adventures is exempt from any liability in relation to the loss of objects that were under the direct responsibility of travelers or third parties. Objects that, in any case, may be considered lost by the Clients, must be claimed by them directly at the places where the loss occurred.

8. SPECIFIC CONDITIONS OF CHANGES AND CANCELLATIONS OF ACCOMMODATION OR TOURIST SERVICES

ANY CHANGES AND CANCELLATIONS OF ACCOMMODATIONS AND ACTIVITIES, OR OTHERWISE, MUST ALWAYS BE MADE THROUGH THE COMMUNICATION CHANNELS AVAILABLE AT THE ELECTRONIC ADDRESS AT WHICH THE CUSTOMER MADE THE PURCHASE.

 

A. CANCELLATION OF THE RESERVATION OR SERVICES BY THE CUSTOMER

(i) Cancellation of the reservation within a period of less than 48 hours for any of our products or services will subject the Client to payment of a fine of 20% (twenty percent) of the amount initially contracted.

(ii) An administrative cancellation fee will also be charged, in the amount equivalent to 5% (three point eighty percent) of the total amount of the reservation when payment is made by credit card or any other means of electronic payment or receipts. banking, excluding direct payment. checking account deposits for Miri Adventures. C. CANCELLATION OF RESERVATION, SERVICE, PRODUCT OR ACCOMMODATION THROUGH MIRI ADVENTURES

Miri Adventures reserves the right to cancel the reservation, service, product or accommodation in the following cases: (i) non-payment by the Client of the price in the agreed manner; (ii) breach, by the Client, of any of its obligations; or (iii) due to acts of God and force majeure.

9. SUPPLIERS

Proof of imprudence, negligence, incapacity or bad faith in the supply will impute to the service providers the obligation to reimburse the Clients for all damages and losses caused, as well as any lien arising from the provision of the services in breach of the contract.

10. RIGHT TO REPENTANCE

For contracts related to the intermediation of the marketing of accommodation and excursion services offered by Miri Adventures, the Client may regret it within the legal period of 07 (seven) days from confirmation of the purchase. To do this, the Client simply needs to contact through the website that made the purchase, requesting repentance and the contract will be duly resolved without the application of any of the sanctions established in this instrument.

11. COMPLAINTS

Any claim related to the accommodation or excursion given by Miri Adventures must be made to Miri Adventures Customer Service (SAC) within 30 (thirty) days after the completion of the contracted services. The Miri Adventures SAC can be contacted through the website in the chat available on the page where the Client made their purchase.

12. FINAL CONSIDERATIONS

(i) does not intend to completely exhaust in these Terms and Conditions the matters related to the rules and procedures, and undertakes to treat any omission in this instrument with essential common sense, with the most careful consideration and in good faith.

13. ACCEPT THE TERMS AND CONDITIONS

The Client expressly declares to accept the Terms and Conditions specified above, with the Client’s “acceptance” available on the website of Miri Adventures and its partners before completing the purchase of travel services and products.
